I. Definitions

  • Client – a natural person, a legal entity, or an organizational unit that is not a legal entity (to which special regulations grant legal capacity) who places an Order through the Store.
  • Consumer – according to Art. 22[1] of the Civil Code, a natural person entering into a legal transaction with an entrepreneur that is not directly related to that person’s business or professional activity, as well as an Entrepreneur with Consumer Rights.
  • Entrepreneur with Consumer Rights – a natural person entering into a contract directly related to their business activity, where the content of the contract indicates that it does not have a professional character for that person.
  • Civil Code (CC) – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).
  • Terms and Conditions – these Terms and Conditions defining the general conditions of sale and the rules for providing electronic services via the online store https://shielddefencesolution.com/.
  • Shield Defence Solutions – the online store available at https://shielddefencesolution.com/ through which the Client may place Orders.
  • Goods – the products and services presented in the Online Store.
  • Sales Agreement – an agreement for the sale of Goods within the meaning of the Civil Code, concluded between the Shield Defence Solutions online store and the Client via the Store’s website.
  • Consumer Rights Act – the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827, as amended).
  • Electronic Services Act – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
  • Order – the expression of the Client’s intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.

II. General Provisions

These Terms and Conditions set out the rules for using the online store available at https://shielddefencesolution.com.

This document is the regulation referred to in Art. 8 of the Electronic Services Act.

This document defines:

  • rules for registration and using an account;
  • terms for placing Orders electronically;
  • rules for concluding Sales Agreements;
  • procedure for handling complaints.

To use the website, you need a computer with OSX or Windows XP/7/8 or newer, and a modern web browser (Safari, Firefox, Chrome, IE 2012+), with cookies enabled.

The store may restrict access to individuals under 18 years of age.

You can always access, download, and print these Terms and Conditions in PDF format using Adobe Reader or similar.


III. Rules for Using the Online Store

  • Registration: Optional. Clients can place Orders without registering. Registration requires acceptance of Terms and Conditions and providing necessary personal data.
  • Access Restrictions: Shield Defence Solutions may restrict or revoke access for violations of the Terms and Conditions:
    • Providing false or outdated data
    • Violating others’ personal rights
    • Behavior contrary to law, Internet norms, or store reputation
  • Security Measures: We use technical and organizational measures to prevent unauthorized access and data manipulation.
  • Client Obligations:
    • Use in accordance with Polish law and Internet etiquette
    • Do not transmit unlawful content
    • Do not disrupt store functioning
    • No spam
    • Do not burden other users
    • Use content for personal use only

IV. Procedure for Concluding a Sales Agreement

  • Selecting Goods: Add items to cart
  • Order Placement: You can edit data until final confirmation
  • Order Summary: Includes description, price, and costs
  • Finalizing the Order: Accept Terms, enter data, and confirm
  • Invitation to Contract: Order info is an invitation. Agreement is concluded upon confirmation email.
  • Language: English
  • Record Keeping: Order details and Terms sent via email; past orders visible in your account

V. Delivery

  • Delivery Area: Worldwide shipping available
  • Delivery Methods:
    • Courier services (e.g., UPS, DHL, FedEx)
    • Parcel lockers (where applicable)
  • Delivery Costs:
    • Rest of the world: Calculated at checkout based on destination and courier rates
  • Delivery Time:
    • Poland: up to 3 working days depending on payment method
    • European Union: 3–10 working days
    • Rest of the world: Typically 7–14 working days, depending on destination
  • Damage During Transport:
    • For Consumers, risk of damage or loss is borne by the store until delivery
    • For Non-consumers, risk transfers to the buyer once goods are handed over to the courier

VI. Prices and Methods of Payment

  • Prices: In USD and EUR, including VAT and all applicable charges
  • Payment Methods:
    • Bank transfer
    • Stripe financing

We may limit available payment methods.


VII. Right of Withdrawal from the Contract

A Consumer has 14 days to withdraw from a contract without giving any reason.

Right of Withdrawal

Withdrawal period starts upon receiving the goods. Notify us via email with order number and return details.

Effects of Withdrawal

  • Full refund including delivery costs within 14 days
  • Refund made by the original payment method
  • Goods must be returned within 14 days of notice

Exclusions

No right of withdrawal for custom goods, opened hygienic items, or as otherwise specified by law.


VIII. Complaints and Claims

We deliver defect-free Goods. Complaints via email.

If needed, we cover return shipping. If return is difficult, we will agree on location and method.

Complaints processed within 14 days.


IX. Complaints Regarding Electronic Services

We ensure proper operation of the store and fix reported issues within reasonable time.

Disputes can be resolved by arbitration at the Voivodeship Trade Inspection Office or via the EU ODR platform: http://ec.europa.eu/consumers/odr/

X. Final Provisions

  • The store is not responsible for email issues on the client side
  • Consumer disputes go to the court of the client’s location; others to the store’s jurisdiction
  • In case of conflict with the law, legal regulations prevail
  • All product names are used for identification and may be protected
  • We may change these Terms, but changes don’t affect already placed Orders
